Effective July 1, 2016

JOBST® Custom-made Garments
Use of Measurements / Return Policy / Warranty Periods

This document has been designed to clearly address the Use and Ownership of patients’ measurements, Return Policy and Procedure, and Manufacturing and Warranty periods for all JOBST® brands of custom-made compression garments.

Return Policy

JOBST® Elvarex®, JOBST Elvarex® Soft, JOBST® Elvarex® Plus, JOBST® Custom Seamless Soft, JOBST ® Relax and JOBST® Bellavar® garments must be returned for replacement due to manufacturing defect or material flaws. In addition, two free of charge replacements will be allotted within 45 days of confirmed delivery of parcel carrier for reasons other than manufacturing or material flaws, such as adjustments to measurements, any changes to options or styles, and changes in compression. This applies to the first and second replacements of the initial order only. For each additional replacement (above two replacements or more than 45 days from the delivery of the original garment) requesting changes to the garment, a full price fee will apply. It is only required to return a garment if there is a defect, complaint, or problem that has been alleged. If defects are not being alleged in the product and the return is being made based on other factors, it may not be necessary to return the garment back. If the patient wishes to return the garment due to manufacturing or material flaws or for other reasons, such as fit or comfort concerns, and does not wish to have the garment remade, the garment may be returned within 45 days of original confirmed delivery of the garment for a half price credit. Credit shall be issued upon receipt of the garment. BSN Medical Inc. reserves the right to amend this policy as it deems appropriate and at any time.

JOBST ® Custom Seamed and JOBST ® FarrowWrap ® garments must be returned for replacement due to manufacturing defect or material flaws. Manufacturing Warranty Policy

JOBST® Custom Seamed products have a three month manufacturing defect warranty. If a manufacturing defect is present, and BSN Medical Inc. reserves the right to insist on a full evaluation of the garment to confirm that a defect is present before replacing the product or issuing credit for the initial purchase. JOBST® Elvarex®, JOBST® Elvarex® Soft, JOBST® Custom Seamless Soft, JOBST® Bellavar®, JOBST® FarrowWrap®, and JOBST® Relax products, have a six month manufacturing defect warranty. If a manufacturing defect is present, BSN Medical Inc. reserves the right to insist on a full evaluation of the garment to confirm that a defect is present before replacing the product or issuing credit for the initial purchase. This warranty for all JOBST® custom products does not cover the garments for normal “wear and tear”, abnormal care and use, where it can be shown that donning instructions have not been followed correctly, or when there has been an error in completing the appropriate order form(s). BSN Medical Inc. will not offer full credit for custom compression garments that are returned, however, if a JOBST® garment should be returned for another JOBST® brand of custom-made garments, then a credit will be considered for the original garment amount when the order for the new brand selection is processed. A Return Authorization is required for all custom compression returns. No credit will be given for orders that are returned outside of the manufacturing warranty period.

Alterations & Repairs

BSN Medical Inc. also offers a limited amount of alterations to existing JOBST ® Elvarex ® , Elvarex Soft ® , Custom Seamed, and FarrowWrap ® . Consult with your customer service representative for available alteration options. BSN Medical Inc. will not alter or repair a garment if the cause of the damage is wear and tear. Additionally, the garment must be in “like new” condition to receive an alteration. Any chargeable options that are added to the existing garment will be invoiced accordingly.

General Acknowledgement

In the case of a warranty claim or question, please contact BSN Medical Inc. and ask to speak to a representative of the specific brand of garment in question for assistance and clarification.

Limitation of Warranty:

BSN Medical Inc. (Seller) warrants that the JOBST ® brand custom-made products are manufactured and function in accordance with the Seller’s ratings and specifications. All products are to be inspected fully by the Buyer and all obvious non-conformities reported to the Seller immediately. The Seller, upon being satisfied of the existence of such non-conformity for which it is liable, will correct the same by either servicing, replacement, or credit. The foregoing shall be Buyer's sole and exclusive remedies. The warranties set forth apply to both original and replacement Products.

No Informal Warranties:

Any advice, information, or suggestions given by Seller to Buyer in regard to the application or use of the Products are not warranties unless given in writing and designated specifically by Seller as warranties. Statements made in Seller's general advertising or printed materials do not constitute warranties.
Samples are not warranted as conforming to Seller's ratings and specifications, nor is any warranty made that Products conform to any sample, unless Seller specifically so warrants in writing. Seller makes no warranty that any Product delivered under this Contract is identical in nature or quality to any Product previously sold or delivered to Buyer.

Warranty Exclusions:

THE FOREGOING WARRANTIES SHALL BE IN LIEU OF ALL OTHER WARRANTIES AND THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PURPOSE AND OTHERWISE, EXPRESS OR IMPLIED, ARE EXCLUDED.

Return or Destruction

No Products shall be returned or destroyed without Seller's prior consent.

Returning Garments

BSN Medical Inc. requires a Return Authorization before returning any custom-made compression garment. This authorization may be obtained for Elvarex, Custom Seamless Soft, Bellavar, and FarrowWrap products by contacting Customer Service.

NOTE:Custom Product Return Authorizations are valid for 45 days. After 45 days, the original Return Authorization will be void. The Return Authorization Number must appear on the outside of the package for the product to be returned to the below address. All custom garments that are returned to BSN Medical Inc. must be laundered and in a sanitary condition in order to receive credit or replacement. Garments sent unlaundered will be returned to sender without inspection due to biohazard concerns and no credit or replacement will be issued in these instances.

CUSTOM TERMS & CONDITIONS

JOBST® JoViPak® sets forth certain general Terms & Conditions regarding purchasing, pricing, returns, etc., as briefly described here. This information is not meant to be entirely inclusive and JOBST® JoViPak® should be contacted with questions regarding details. JOBST®® JoViPak® reserves the right to amend any Terms & Conditions or other policies herein as it deems appropriate and at any time.

PRICING, ORDERING, PROPRIETARY INFORMATION

JOBST®® JoViPak® pricing (“Pricing Information”) is proprietary and confidential. All buyers agree to treat the Pricing Information as proprietary and confidential and specifically not to disclose any Pricing Information to any entity or to any person not employed by the Buyer except per any required disclosure to a State or Federal agency.
All price lists, catalogs and other brochure and materials, even if they contain prices and other terms, are not offers to sell. Rather, your order, whether transmitted to us electronically, or in writing, shall be deemed an offer to buy, subject to acceptance by us.
Any order placed by you expressly implies that you understand and agree with our Terms and Conditions. Our acceptance of your order does not constitute an acceptance of any provisions on your purchase order or other form of yours that are different from or additional to these terms, and such different or additional provisions are expressly rejected.

PAYMENTS

Net 30 days, unless otherwise specified.

SHIPPING

Shipping charges will apply to all orders and current shipping options and pricing information can be obtained via Customer Service.

WARRANTY POLICY

All JOBST® JoViPak® products are warranted to be free of material or workmanship defects. Any defective merchandise will be repaired or replaced at the discretion of JOBST® JoViPak®. There are no other implied or expressed warranties, including the fitness of the product for certain medical conditions.
In the case of a warranty claim or question, please contact JOBST® JoViPak® Customer Service for assistance and clarification.

LIMITATION OF WARRANTIES

JOBST® JoViPak® (Seller) warrants that the JOBST® JoViPak® products are manufactured and function in accordance with the Seller’s ratings and specifications. All products are to be inspected fully by the Buyer and all obvious non-conformities reported to the Seller immediately. The Seller, upon being satisfied of the existence of such non-conformity for which it is liable, will correct the same by either servicing, replacing, or crediting. The foregoing shall be Buyer’s sole and exclusive remedies. The warranties set forth apply to both original and replacement products.

NO INFORMAL WARRANTIES

Any advice, information, or suggestions given by Seller to Buyer regarding the application or use of the products are not warranties unless given in writing and designated specifically by Seller as warranties.
Statements made in Seller’s general advertising or printed materials do not constitute warranties. Samples are not warranted as conforming to Seller’s ratings and specifications, nor is any warranty made that products conform to any sample, unless Seller specifically so warrants in writing. Seller makes no warranty that any product delivered is identical in nature or quality to any product previously sold or delivered to Buyer.

WARRANTY EXCLUSIONS

The foregoing warranties shall be in lieu of all other warranties and the warranties of merchantability and fitness for purpose and otherwise, express or implied, are excluded.

VOID OF WARRANTY

Warranties provided will be considered null and void under certain circumstances. Warranty may be void if:
• the warranty period has expired, or
• a particular product or part is not covered, or
• a product has been mis-used, not properly maintained, or not used as intended by the manufacturer, or
• a product has been altered in any manner by anyone other than the original manufacturer.
This list is not intended to be comprehensive or limiting. Please contact us if there is any question about a warranty.

WARRANTY PERIODS

JOBST® JoViPak® reserves the right to insist on a full evaluation of any garment where there is a potential warranty concern related to a manufacturing defect or a materials defect. Evaluation will be performed to confirm that a defect is present before either replacing the product or issuing credit for the initial purchase.

JOVIPAK® CUSTOM TERMS & CONDITIONS

Any warranty, whether for Ready-to-Wear product or for Custom Made product, does not cover normal “wear and tear”, abnormal care and use (for example, where it can be shown that donning instructions were not followed correctly), or when there has been an error in completing the appropriate order form(s). The use of bleach, fabric softeners, dryer sheets, or excessive heat will void any warranty. Garments worn beyond their intended usage period, inconsistently with their usage intent, or misused are not warrantied.

MANUFACTURING WARRANTIES

JOBST® JoViPak® does everything possible to create garments that are free from manufacturing related defects. If, however a manufacturing defect is found, please contact us within 30 days from the date of shipment to discuss options. No credit will be given for products that are returned outside the manufacturing warranty period.

RETURN & EXCHANGE POLICY

Ready-To-Wear garments are returnable if there is a defect in manufacturing or in materials. Once garments are received, an evaluation will be completed by JOBST®® JoViPak®® to determine that a defect is present before replacing the product or crediting the account. Possible defects must be discussed with JOBST® JoViPak® within 30 days from the date of product shipment.
Custom Made garments are not returnable but may be eligible for one (1) free of charge replacement within the first 45 days from the date of shipment. This replacement shall be allotted for reasons such as but not limited to, manufacturing or material flaws, adjustments to measurements, any changes to options or styles, and changes in compression. This applies to the first replacement of the initial order only. For each additional replacement (above one replacement or more than 45 days from the delivery of the original garment) requesting changes to the garment, a full price fee will apply.
It is only required to return a garment if there is a defect, complaint, or problem that has been alleged. If defects are not being alleged in the product
and the return is being made based on other factors, then it may not be necessary to return the garment. No credit will be issued for obsolete or otherwise non-saleable merchandise (e.g., visible signs of wear & tear, soiled). Products are non-returnable and non-refundable after 60 days from the date of shipment.
Ready-to-Wear garments must be in new condition – unworn and in original packaging - to receive credit or replacement. Garments not in new condition will be returned to sender without inspection due to biohazard concerns. No credit or replacement will be issued in these instances. No products shall be returned or destroyed without the prior consent of JOBST® JoViPak®.

RETURN & EXCHANGE PROCEDURE

JOBST® JoViPak® requires a Return Authorization number (RA#) before returning any garment. The RA# may be obtained by contacting Customer Service at (866) 888-5684 with the following required information: full description of merchandise, complete reason for return, and Sales Order number, Invoice number, or Purchase Order Number.
RA#s issued will be valid for 45 days from the date it is provided. After 45 days, the RA# will be void. The RA# must appear on the outside of the package for the product as well as on any paperwork provided inside the box.

JOVIPAK® CUSTOM TERMS & CONDITIONS

ALTERATION & REPAIR POLICY

JOBST® JoViPak® offers a limited amount of alterations and/or repairs to JOBST®® JoViPak® garments.
JOBST® JoViPak® Custom Made garments sold in the United States are eligible for one (1) free reduction alteration within the first year of ownership. Other alterations may be chargeable and should be discussed with Customer Service before garments are shipped to JOBST® JoViPak®. Further, any chargeable options that are requested to be added to an existing garment will be invoiced accordingly.
In some instances, Ready-to-Wear garments sold in the United States may also be eligible for chargeable alterations or repairs. Contact Customer Service to discuss options.
JOBST® JoViPak® will not alter or repair any garment if the cause of the damage is normal “wear and tear”. Additionally, garments must be in “like new” condition to receive an alteration. “Like new” condition is defined as freshly laundered and free of any foreign matter. Garments sent unlaundered will be subject to a laundering fee or, in some cases, declined to be cleaned/altered.

REIMBURSEMENT DISCLAIMER

*The Centers for Medicare & Medicaid Services (CMS) uses Palmetto GBA as the Pricing, Data Analysis, and Coding (PDAC) Contractor. The PDAC Contractor maintains the Product Classification List, located at https://www4.palmettogba.com/pdac_dmecs/. The Product Classification List is a searchable database containing products that have received HCPCS coding verification from PDAC and their corresponding HCPCS codes. BSN Medical Inc., however, makes no representations as to the accuracy of the information contained within the PDAC database, nor any representations as to whether its products are reimbursable under any government sponsored healthcare program and/or private-insurance program. It is the provider’s sole responsibility, in consultation with the insurer, if necessary, to determine medical necessity, ensure coverage criteria is met, and submit appropriate codes, modifiers, and charges for services rendered.
